These Terms of Service govern your use of FallingWest.ca and purchases made through the Canadian Falling West storefront.
1. Using FallingWest.ca
Falling West provides apparel, product information, and related online services through FallingWest.ca. By using this website, you agree to use it only for lawful purposes and in accordance with these Terms.
2. Prices, Taxes, and Payment
FallingWest.ca is intended to display prices and process purchases in Canadian dollars (CAD). Applicable shipping charges and taxes, if any, are shown or calculated during checkout as required by the store configuration and applicable law.
Payments are processed by third-party payment providers. We may correct pricing, description, or technical errors when reasonably necessary.
3. Orders and Acceptance
Submitting an order does not guarantee acceptance. We may refuse or cancel an order where reasonably necessary, including because of pricing or listing errors, payment problems, suspected fraud, unavailable products or variants, fulfilment limitations, or misuse of the website.
If an order is cancelled after payment has been collected, any required refund will be processed to the original payment method.
4. Made-to-Order Products
Falling West products are generally made to order. Production begins after an order is placed, so changes or cancellations may not be possible once production has started.
5. Shipping and Delivery
Shipping methods, costs, tracking, production times, and estimated delivery times are described on our Shipping Information page and during checkout where available.
Delivery estimates are not guarantees. Carrier delays, weather, remote-location service, fulfilment availability, and other factors outside our control may affect delivery.
6. Returns, Replacements, and Refunds
Because products are made to order, our return and replacement rules differ from those of a traditional inventory-based retailer. Please review our Returns & Replacements page before ordering.
Nothing in these Terms or our return policy limits any mandatory rights or remedies available to you under applicable Canadian federal, provincial, or territorial consumer-protection law.
7. Product Images and Descriptions
We work to present product descriptions, colours, artwork, and mockups as accurately as reasonably possible. Actual colours may vary slightly because of screen settings, garment production, and printing processes. Minor placement or print differences can also occur in made-to-order production.
8. Intellectual Property
Unless otherwise stated, Falling West owns or is authorized to use the website content, branding, graphics, product artwork, text, photographs, videos, and other materials made available through Falling West.
You may not copy, reproduce, distribute, sell, modify, or commercially exploit Falling West content without permission except where permitted by law.
9. Third-Party Services
Falling West relies on third-party services for functions such as ecommerce, payment processing, production, fulfilment, shipping, hosting, security, and analytics. Those services may be governed by their own terms and privacy policies.
We are not responsible for outages, carrier delays, service interruptions, or third-party platform changes beyond our reasonable control, subject to any rights that cannot legally be excluded.

11. Limitation of Liability
To the extent permitted by applicable law, Falling West is not liable for indirect, incidental, special, consequential, or punitive damages arising from use of the website or third-party services.

These Terms are governed by the laws of Canada and the laws of the applicable province or territory having jurisdiction, without limiting any mandatory consumer-protection rights that apply based on where you live.
